نظام تمويل التقاضي امام القضاء و التحكيم

يعد التقاضي من اهم وسائل اقتضاء الحقوق وتحقيق العدالة، وموضوع بحثنا يتناول فكرة تمويل التقاضي سواء امام القضاء او هيئة التحكيم ومن خلال دراستنا نحاول تسليط الضوء على الجوانب الايجابية ومحاولة تفادي السلبيات التي من شأنها التأثير على الهدف الاساسي المبيغى من ذلك النظام ووجدنا ان هذا النظام قد لقى قبولا لدى العديد من الدول المتقدمة ومنها سنغافورة وفرنسا والولايات المتحدة وبوتان وغيرها من الدول، فذلك النظام يواجه مشكلة تعرض أحد الاطراف الذي لديه حق يرغب في أن يدافع عنه ويجد ذلك الطرف انه لا تتوافر لديه الموارد المالية اللازمة لتمويل منازعته القضائية أو التحكيمية، فيعد اللجوء لنظام تمويل التقاضي هو السبيل الوحيد لمساعدة من يرغب في اقتضاء حقوقه، وحتى يكون ذلك النظام محققا للهدف المبيغى منه يجب وضع العديد من الضوابط والشروط لتنظيم عملية التمويل حتى نكون بصدد ادخال نظام متكامل يحقق الهدف منه وهو تحقيق العدل واقتضاء الحقوق دون الوقوع في السلبيات التي قد تنال من ذلك النظام وتفقده اهميته.
Abstract:
Litigation financing or financing from a third party (THIRD PARTY FUNDING) Its
importance lies in protecting the weak party who is financially unable, so the cost of resolving
disputes should not prevent him from obtaining his rights. If he is involved in a commercial dispute,
he can resort to the commercial litigation financing system without exposing his money risk and loss.
That system enables those who cannot afford to seek justice and equalize the parties, and TPF
is increasingly being welcomed as a smart business method, which allows companies to maintain
liquidity and continue their profitable projects, by using external capital to fund their legal disputes,
they do not tie their money in arbitration or lose competitive credit rates (which usually deteriorate
when involved in legal proceedings, as the value of their claims cannot be assessed through traditional
commercial loan services)
We can describe the litigation financing system as the lifeblood of the justice system, and the importance of litigation financing has been clarified because it achieves "justice between man and
man". They are violations of the private rights to enjoy life, liberty, property, or otherwise that can be
compensated as much as possible, by means of compensation and compromise, and if necessary, by t
aking appropriate means for the social need to give full and effective value to the fundamental
rights of members of society that would be diminished or stripped of value or even of reality
