آثار تطبيق نظام السجل العيني على انتقال الملکية العقارية

الملخص العربى :
هدفت هذه الدراسة إلى توضيح مدى أهمية تطبيق السجل العيني على انتقال الملکية بين المتعاقدين والغير، وکذلک التطرق لأهمية تطبيق السجل العيني لما يقوم عليه من رکائز أهمها الحجية المطلقة للبيانات المقيدة في السجل العيني.
وقد جاءت مشکلة الدراسة من خلال التساؤل: ما أثر تطبيق نظام السجل العيني نقل ملکية العقار بالنسبة للمتعاقدين والغير؟
وقد اتبعت خلال هذه الدراسة المنهج الوصفي لمناسبته لذلک النوع من الدراسات.
وقد خرجت بعدة نتائج أبرزها: أنه يترتب على القيد في نظام السِّجل العيني نقل التصرفات والأحکام الکاشفة أو المقررة للحقوق العينية العقارية الأصلية بالسِّجل العيني، ويترتب على قيد حق الملکية لشخص ما أن يظل هذا الحق في مواجِهة الکافة إلى أن ينقله للغير بقيد جديد أو يرد على هذا القيد من صاحب مصلحة بطلان ذلک التصرف وبالتالي بطلان القيد بدعوى البطلان، کما يعد نظام السِّجل العيني هو الداعم الأکبر لتداول العقارات وتحقيق الثقة العامة بها فالشخص لا يمکن اعتباره صاحب حق أمام الناس إلا إن کان حقه مُثبت في السِّجل العيني.
کما خرجت بعدة توصيات أبرزها: وجوب الإسراع في تطبيق نظام التسجيل العيني للعقار، لحفظ حقوق الملکية العقارية، وضرورة إعطاء موظفي الشهر العقاري دور الرقيب على صحة العقود الخاصة بالعقارات، إذ أنه کثيرًا ما يکتنفها الغموض وعدم الدقة رغبة في التلاعب على أحد طرفي العقد او التحايل على قواعد القانون واجراءات التسجيل، والعمل على توجيه الجهات المختصة بالدولة بتسخير کافة الامکانيات المادية والتفننية وذلک بغرض تعميم تطبيق نظام السجل العيني، نظرًا لما يمثله من أهمية بالغة لحماية جميع المتعاملين على العقارات، واهمية ما يدره على الحزينة العامة من عائدات.

This study aimed to clarify the importance of applying the in-kind record to the transfer of ownership between the contracting parties and others, as well as addressing the importance of applying the in-kind record because of its pillars, the most important of which is the absolute authenticity of the data recorded in the in-kind record.
The problem of the study came through the question: What is the impact of the application of the in-kind registry system on transferring property ownership for contractors and third parties?
During this study, the descriptive approach was followed due to its relevance to this type of studies.
It came out with several results, the most prominent of which are: The registration in the tangible register system entails transferring the actions and rulings revealing or determining the original tangible rights to the original real estate in the tangible register, and the registration of the property right of a person entails that this right remains in opposition to all until he transfers it to others with a new entry or responds to This entry is of the interest of invalidating that act and thus invalidating the record on the claim of invalidity, and the real estate registry system is the biggest support for real estate trading and achieving public confidence in it.
It also came out with several recommendations, most notably: the necessity to speed up the implementation of the real estate registration system, to preserve real estate property rights, and the need to give the real estate registry employees the role of monitoring the validity of contracts for real estate, as it is often shrouded in ambiguity and inaccuracy in a desire to manipulate one of the parties to the contract or deceive On the rules of the law and registration procedures, and work to direct the competent authorities in the state to harness all the material and technical capabilities in order to generalize the application of the in-kind registry system, given the great importance it represents to protect all real estate dealers, and the importance of the revenues it generates on the public grievance.
